By accessing or using Sendly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Sendly Technologies ("we", "us").
You must provide a valid email address and accurate business information to create an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use Sendly.
Sendly is an email marketing platform that allows businesses to connect their databases, create email campaigns, manage contacts, and track analytics. Additional features include WhatsApp messaging, SMS, and automation flows depending on your plan.
You agree NOT to use Sendly to:
Violation of these terms may result in immediate account suspension or termination.
All plans are billed in your local African currency via supported payment providers (Paystack, Flutterwave, M-Pesa). Subscriptions renew automatically. You may cancel at any time from your dashboard. Overage charges apply at the equivalent of $0.005 per email above your plan limit. Refunds are available within 7 days of initial subscription only.
You own all data you upload or connect to Sendly, including contacts, templates, and campaign content. We do not claim ownership of your data. Upon account deletion, your data will be permanently removed within 30 days.
The Sendly platform, brand, design, and built-in templates are the intellectual property of Sendly Technologies. You may not copy, modify, or distribute our platform. Custom templates you create remain your property.
We target 99.9% uptime for Business plan subscribers. We do not guarantee uninterrupted access for free and lower-tier plans. Scheduled maintenance will be communicated at least 24 hours in advance.
Sendly is provided "as is." We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Either party may terminate at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data remains accessible for 30 days, after which it is permanently deleted.
These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through arbitration in Lagos, Nigeria under the rules of the Lagos Court of Arbitration.
